We are looking for a Head of Contract & Risk Management Offshore for Hoboken.
As Contract and Risk Manager you will be the first contact point at division management level for all contract and risk matters. You will be responsible for the correct implementation within the organization of the contract management and risk management activities.
Your new challenge at Equans:
- all project contractual activities:
- review of contractual conditions during tendering stage of a project
- from hand-over from Tendering department until all relevant contractual obligations are complete and all relevant contractual issues are resolved/settled
- contract analysis and preparation of Project Contract Management Plan
- contractual briefings:
- advise in responding to contractual queries and assist proactively in the resolution of any issues
- identification of customer/consortium and other third-party obligations including development and implementation of the Project Contract Management Plan
- support and manage project risks and opportunity identification and analysis
- positive business relationship with Contract Management team from client and/or partners:
- regular communication and coordination to resolve issues
- review all incoming contractual correspondence and prepare/review all outgoing contractual correspondence
- ensure proper notices are given in line with contract requirements
- management of claims to/from clients and consortium partners
- preservation of Equans’ rights and entitlements as provided in the contract. Timely processing of project variation requests/orders, prepare and manage claims and counter claims for delays, extension of time, acceleration and disruption. Ensuring appropriate recovery from third parties
- support the management of claims to/from (sub)contractors and suppliers as required
- contractual obligations:
- ensure that the project management staff are fully aware of their contractual obligations and the commercial impacts of their actions
- prepare contract summary and ensure it is updated. Support and guidance to the project team on general contractual issues. Clarification of contractual/legal queries, if required by referring to the Legal department or external legal advice
- ensure elaboration of the Contract Delivery Requirements by the project team members is launched in time, check milestone compliance
- liaise with the Project Planning Manager to ensure contract program and appropriate schedules are produced and maintained to support the project strategy
- liaison with internal departments:
- liaison with Insurance/Bond/Bank/Legal department
- assurance that all contractual and legal documents are correctly maintained and updated
- manage insurance matters, submission, monitoring and settlement of insurance claims in accordance with the policies and in liaison with the central insurance department
- contractual reports:
- active participation in health check reports
- maintain monthly project activity report
- leading the team of contract managers:
- in consultation with the project’s Director and/or Division Manager, supervise a small team of contract managers dedicated to specific projects and integrated in the project teams
- external contacts: clients, partners, suppliers
- internal contacts: Equans’ Offshore departments, Legal
Are we a match?
- degree in engineering, quantity surveying, business administration or law
- relevant experience either in the construction or energy sectors. Intimate knowledge of the finer workings of EPC contracts
- minimum 10 years of experience
- experience in high level negotiations
- understanding of contract law, knowledge of FIDIC (red book & yellow book) contracts is essential
- technical/legal/financial understanding
- preferably knowledge of German law and/or French law and/or English law
- analytical skills and written communication are one of your strong points
- be able to dive into the details of non-contractual matters such as engineering, cost control, planning and construction in order to provide relevant contractual support
- have a sufficiently strong personality to be able to function in a changing environment with high stakes and tight deadlines
- hands-on mentality and very business minded
- strong communication skills
- team player
- able to lead a team
- fluent in English and German, with a thorough knowledge of the legal vocabulary OR fluent in English and Dutch, with a thorough knowledge of the legal vocabulary
